BlackOak FI, Inc., doing business as BlackOak Commerce (collectively, “BlackOak Commerce,” “BlackOak,” “we,” “us,” or “our”), operates the BlackOak Commerce platform. This Privacy Policy explains the categories of information we collect, how we use and disclose that information, and the choices available to you.
Information We Collect
Depending on how you interact with BlackOak Commerce, we may collect:
- Account and contact information, including your name, email address, mailing address, and mobile telephone number;
- Business and merchant information supplied during registration or onboarding;
- Identity-verification and compliance information;
- Transaction, payment, funding, settlement, refund, and account-activity information;
- Communications and customer-support information; and
- Device, browser, log, network, security, and usage information needed to operate and protect the platform.
How We Use Information
We may use information to provide and support the platform; establish and manage accounts; process and settle transactions; verify identity; conduct compliance, fraud-prevention, risk, and security activities; provide customer support; send account and transaction communications; maintain records and enforce agreements; and comply with legal, regulatory, bank, network, and law-enforcement obligations.
SMS and Text Messaging
If you provide a mobile telephone number and affirmatively opt in, BlackOak Commerce may send transactional text messages concerning account verification and security codes and account notifications.
- Consent to receive SMS messages is optional and is not a condition of opening or maintaining an account.
- Message frequency varies based on account activity.
- Message and data rates may apply.
- Reply STOP to unsubscribe from messages sent by that number.
- Reply START to resubscribe where keyword resubscription is supported.
- Reply HELP, or email support@blackoakfi.com, for assistance.
- Carriers are not liable for delayed or undelivered messages.
Opting out of SMS does not prevent BlackOak from providing legally required notices or essential account and security communications through another available and authorized channel.
How We Disclose Information
We do not sell your personal information. No mobile information, including mobile telephone numbers, SMS opt-in data, or SMS consent, will be shared with third parties or affiliates for their marketing or promotional purposes.
We may disclose information to service providers that perform services on our behalf, including payment processing, identity verification, fraud prevention, hosting, customer support, analytics, and message delivery. Those providers may use the information only to provide contracted services to us and not for their own marketing or promotional purposes. We may also disclose information as required by law, regulation, legal process, bank or payment-network requirements, or to protect BlackOak, our customers, or others.
Data Security and Retention
We use administrative, technical, and physical safeguards designed to protect information. No method of transmission or storage is completely secure. We retain information as reasonably necessary to provide the platform, meet legal and compliance obligations, resolve disputes, prevent fraud, and enforce agreements.
Your Choices
You may review or update certain account information through the platform or by contacting us. You may withdraw SMS consent at any time by replying STOP to a message sent by the applicable number. Withdrawal applies prospectively.
Children
The BlackOak Commerce platform is not directed to children under 13, and we do not knowingly collect personal information from children under 13.
Changes to This Policy
We may update this Privacy Policy from time to time. The “Last updated” date identifies the current version. Material changes will be communicated as required by applicable law.
